New York Child Support Calculations

To calculate the basic child support obligation in New York, the court combines your and your ex’s income, minus certain deductions, and multiples it by a percentage that varies on the number of kids you have. Then, that number is divided according to both incomes.

The percentages used to calculate the basic child support obligation are:

  • 17% of the combined parental income for one child
  • 25% of the combined parental income for two children
  • 29% of the combined parental income for three children
  • 31% of the combined parental income for four children
  • no less than 35% of the combined parental income for five or more children

Income can include far more than just wages or salaries. They can include:

  • unemployment insurance benefits
  • workers’ compensation awards
  • disability benefits
  • social security benefits
  • veterans’ benefits
  • pension and retirement benefits

After the judge determines both parties’ gross income, they subtract certain deductions and add the two adjusted incomes together, creating the “combined parental income.” This figure is multiplied by one of the percentages listed above, then each parent’s income is divided into the combined parental income to determine their share.
