Commercial DWI Laws & Penalties in New York

In general, Class A, B, or C license holders are held to a higher standard compared to noncommercial drivers – even if they are driving their personal vehicles. For instance, a CDL holder can be arrested for drunk driving charges in New York with a blood alcohol concentration (BAC) of .04 percent, while the legal limit is .08 percent for noncommercial drivers.

A first offense DWI is punishable by a maximum jail term of one year, fines of up to $1,000, driver’s license suspension (personal vehicle) for at least six months, and CDL disqualification for one year. However, if you were transporting hazardous materials at the time of the arrest, CDL disqualification for a first offense lasts three years.

A second offense carries imprisonment for up to four years, a maximum fine of $5,000, driver’s license suspension (personal vehicle) for at least one year, and permanent CDL disqualification.
